She got kicked off the team because she wouldn't specifically shout his name, or clap for him. That's it. She still participated in EVEY OTHER WAY. Wow. I mean, unless they only have about three other cheerleaders,how would anyone even really know? And who would fucking care?
Oh, and why is a kid who got a MISDEMEANOR sexual assault charge--which was plead down from a FELONY charge--still on the damn team? I'm not sure he should even be in that school, but that's a whole other issue.
I've heard the argument that she could quit cheerleading, but why should the victim have to give up doing the things she likes because the school is run by douche bags?
My husband made a good point that this should not really be a matter for the courts - who is allowed to be a cheerleader and what is expected of them is an internal school matter, not a matter of law (unlike the sexual assault). But still, it seems like a big pile of suck.
OMG! What I find appalling is that the guy, who basically admitted to raping her, was allowed to remain on the basketball team and represent the school and that is considered alright! Seems females are still considered chattle in some places still...
I'd like to know more about what exactly went on between the cheerleader and the school concerning this. Did they just kick her off the team without question? Were they aware of what this person had done to her? Did they give her an option such as turning to the crowd to cheer, instead? The thing is cheerleading is an extracurricular activity, not a school activity (like a pep rally). If you don't cheer, you're not doing what you're supposed to do. I know I would certainly notice if one cheerleader wasn't cheering during certain freethrows or baskets. And I'd be wondering why.
There was a vaguely similar case at the college where I work about four years ago, involving some members of the baseball team, though the girl was not student here:
